Barbara Rich is spot on with her criticism of careless and incompetent reporting. Such inaccuracies lead to misunderstanding as to the law and of the Court of Protection's functions. It is usually left to the legal adviser to have to put the record straight. Those involved in reporting on Court of Protection matters have a responsibility to ensure the basic terminology used is correct to prevent confusion in Court of Protection users.
A barrister has criticised “mainstream media” for its incompetence in reporting of Court of Protection (CoP) cases. Barbara Rich accused “broadsheet newspapers” of publishing “careless headlines” and making “fundamental inaccuracies” in their coverage of a recent court hearing. In a Solicitors Journal article, “Read all about it: Incompetent reports on the CoP”, she wrote: “The media has a vital role in bringing Court of Protection cases to wider public awareness. But, to date, the work even of the serious media has largely failed to accurately explain what the court does and does not decide.”
